You are responsible for maintaining the confidentiality of your account credentials and all activities that occur under your account.

5. User Responsibilities

You are solely responsible for the accuracy of data you submit, compliance with third-party website terms, and ensuring you have authorization to automate on target websites.

6. Prohibited Uses

You may not use the Services to violate any law, submit false information, infringe on others' rights, introduce malware, or engage in unauthorized data scraping or mass outreach.

7. Data and Privacy

Data handling is governed by our Privacy Policy at skyvern.com/privacy. Your data may be processed by third-party LLM providers. You may opt out of model training by contacting support@skyvern.com.

8. Intellectual Property

The Services and all related intellectual property are owned by Skyvern or its licensors. You retain ownership of content you submit.

9. Fees and Payment

Fees are as listed on our Website. All fees are non-refundable except as required by law. You are responsible for all applicable taxes.

10. Service Availability

We do not guarantee uninterrupted service. Third-party websites may change or restrict automated access at any time.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. SKYVERN MAKES NO WARRANTY REGARDING AUTOMATED OUTPUT ACCURACY OR FORM SUBMISSION SUCCESS.

12. Limitation of Liability

SKYVERN'S TOTAL LIABILITY IS LIMITED TO THE GREATER OF FEES PAID IN THE PRIOR 12 MONTHS OR $100. WE ARE NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

13. Indemnification

You agree to indemnify Skyvern against claims arising from your use of the Services, violations of these Terms, or violations of third-party terms.

14. Termination

Either party may terminate the agreement. Upon termination, your right to use the Services ceases immediately.

15. Governing Law and Dispute Resolution

These Terms are governed by Delaware law. Disputes are resolved by binding arbitration in Wilmington, Delaware. Class action waivers apply.

16. Changes to These Terms

We may revise these Terms at any time. Continued use constitutes acceptance of changes.

These Terms constitute the entire agreement between you and Skyvern. Provisions include severability, no waiver, no assignment without consent, and no third-party beneficiaries.
